We, the same ratepayers and Maitai-centric citizens who were here in 2006 when the then NCC’s own Urban Growth Strategy roundly determined “NOT TO PROVIDE ANY FUTURE RESIDENTIAL ZONING IN THIS AREA” contend again that sacrificing the only multi-recreational natural freshwater amenity available to city dwellers is a breathtaking betrayal by this Council of Nelsons community, to the wants of vested interest, never mind a slavish adherence to a previous Government decree, over the clear preference of the living community here today and their children for generations to come. Simply-put, the Maitai Valley is a “Once-Only” natural recreational wonder for city dwellers. It is not a Council land-bank to be used or sold at will, it is as much an inter-generational heritage to this community as is Tahunanui Beach. Almost on its own the Maitai Valley anchors Nelsons envied reputation as a uniquely desirous and efficacious place to live and grow. We object, in the strongest possible terms, that this Council cease bending-over backwards to the whim and will of local developers and on behalf of this community, who deserve better than what we’ve witnessed so far, tell them to “The Maitai and Kaka Valleys are NOT available … go away.” | 168.11 |

| $24M put aside for infrastructure, should the Kaka Valley Development proceed I would like to object to this funding being put aside for this proposed development, without any guidance as to what the Developers might contribute. It seems ratepayers could unknowingly be heavily subsidising a private sub-division from which the developers stand to profit enormously. Thanks to a tenacious group of locals, this matter is in the hands of the Environment Court but throughout this process the outcome seems heavily favoured towards the developers. I still find it astounding that this group of locals have had to fund raise and really push to be heard on a matter that Council should have had the foresight not to allow to proceed through the RMA process in the first place. If Council place any value on the Maitai (which they and the Developers seem to say they do) then they would not even consider allowing any development on the natural flood plain that forms part of the land in question. This was surely highlighted further by the weather event of August 2022. Who knows what further devastation would have been caused, had the proposed intensive development been in place at that time. I believe time will give us the answer on that one. I am astounded that the developers have to date been able to get away with eloquent speeches about how precious they believe the area to be but for some reason have so far refused to actually put plans in place to illustrate just how they will mitigate the impact such a huge development will have. Does that not strike anyone at Council as nefarious? In addition, while I commend what they are saying about providing housing for their Iwi, I have yet to see anything that shows how they are intending to do that. Are they giving, say, 20 homes to those who need it? While I would like to be proved wrong, I really do not think this will be the case. This is a private development with the sole goal of making huge profits for their shareholders, despite the impact on a much loved, peaceful area of our city. Please do not include the $24 Million of ratepayers funding in the Long Term Plan, without at least some commitment from the Developers as to how much they will contribute - and that should be a substantial amount as they are the individuals who stand to profit whereas ratepayers will be subsidising them for many years to come. Like Central PArk for NY City, a piece of wilderness so close to the Nelson CBD is a landmark feature for our city and we cannot loset it. | I have been a Nelson citizen since 1959 and feel that during those decades, I have been a good citizen and active in several ways towards the betterment of Nelson. I DO NOT WANT NCC to spend $24,000,000 of ratepayers funds to support the Mahitahi Bayview private subdivision. A large part of the subdivision is on a natural floodplain. The subdivision is likely to increase the flood risk downstream. I am against the whole plan for the following reasons: 1 No flood modelling has been done to assess the risk of increased flooding to downstream areas. I live downstream, very close to the river, in an area that was badly affected by flooding in August 2022. The council could become liable for compensation should these flood risks be realised. 2 Increased sedimentation of the river is likely to occur when the construction work is started, causing harm to the aquatic life, on which large sums of money have recently been spent on rehabilitation. 3 The quality of the water in the river is likely to be spoiled by pollutants. 4 The only road access to the new development will be via Nile St, so there will be a vast increase in the amount of traffic along this road, both during and after the building. There are examples overseas that this system of housing creates big financial problems which will eventually fall to the citizens and ratepayers to cope with. There are plenty of examples where this type of housing has been shown to be an error, a financial disaster. (This comment is based on the fact that if you are planning to spend $24 million on upgrading the services, and the subdivision doesn't go ahead, you have spent the money unnecessarily, which means you have already made your mind up) They need to pay for the upgrade themselves in my opinion, after all they stand to make millions of dollars from 900 houses. The developers will say they have plans to mitigate any future flooding and silt runoff during construction, but you won't know if their plans are successful until it happens. Their application does not have any earthworks plan or accurate flooding modeling so until they produce those I suggest you stop supporting their development. The subdivision will require earthworks which will inevitably send a huge amount of topsoil and silt into streams, the river and then to Paraoroa/Nelson Haven and then to TeTai-o-Aorere/Tasman Bay. For over fifty years, I have been involved in Top of the South Island coastal conservation. I have noted the devastating effects of accelerated erosion on the coastal zone. The silt smothers the eelgrass communities in the estuary and then smothers the benthic communities of shellfish and other invertebrates on which coastal productivity depends. The seabirds, fish and ocean mammals depend on these invertebrate communities. We know that all these native vertebrates are decreasing in numbers and some are headed for extinction. We are killing benthic communities with silt, when we need to be working on restoration. I have noted the attempts in Nelson to capture the silt from earthworks in holding ponds, but the proof of the ineffectiveness is in the muddy streams after rainfall. The need for affordable housing is urgent. Clearly, building where infrastructure - water, energy, roading, public transport, etc - is already in place or nearby is the first priority. I note that there is already surplus housing in Nelson, judging by the expensive, multicoloured, multimedia advertisement for retirement accomodation in Nelson with which I am inundated. Housing needs to be for all ages, not just ghettos for older people. I also note that Nelson, according to the latest census (2018) has 500 unoccupied houses. In my central neighbourhood there are homes which sit empty much of the year since the owners live elsewhere. Can we develop ways of getting these houses used year round ? | 927.2 |

I live at 204A Nile Street. Since the earthworks/gravel excavations around the Maitai Golf Course in 2023 I have noticed a huge amount of gravel/sand, small rocks being swept downstream. Every heavy rainfall more gravel, sand arrives and deposits in front of 204A. A hitherto deep channel of water is now being replaced by gravel/sand which impedes the river flow making water levels rise drastically in heavy rain because the deep channel has gone. A little more of the retaining river bank is being gradually eroded due to the rising water volume. Ratepayers will basically subsidise this private subdivision which would be built in a flood zone. There is plenty of photographic evidence to suggest that the location of this proposed subdivision is totally unsuitable. * Any earthworks undertaken will hugely affect the stability of the land. Further flooding of the valley will erode and cause massive silt extraction flowing out to Nelson, then the sea. Silt will potentially build up and cause flooding of Nelson town down stream. Potentially many households would need to be compensated for by the council if properties in this area are affected by this flooding. Damage to river banks, infrastructure such as roads would be devastating. *New houses in the subdivision will struggle to get insurance. * Green field subdivisions are a costly and unsustainable use of land with ongoing maintenance and flood repair. Climate change weather events as we previously experienced will increase in severity and frequency. This development in the Maitai will become an ever increasing liability. * The land in this valley should be used for recreation and the enjoyment of tranquility for the people and be further enhanced. Places like these are rare and should be preserved for future generations. * Between 6000 and 7000 car movements are expected to drive through adjoining roads and will become a traffic hazard. Nile Street, Collingwood St will become major arteries having to accommodate this traffic, making these roads extremely unsafe for its local residents. Traffic noise and exhaust fumes will be intolerable. Nelson is too small to cope with the extra traffic volume. I think that Nelson City Council should look after its existing residents, discourage subdivisions like these to be established in a beautiful but flood prone area and spend the $24 million on more desirable projects | 949.2 |

This development and the concrete placements – roading , drives, paths etc could well reduce natural seepage. This will put more flow into the Maitai. I live down street and about 50 metres from the river ( Mill St ). Currently I have not been affected by the overflow during heavy rain. This development might change this and in doing so undermine the value and ability to insure my property. This is our last valley in the district that is not developed. It is such a valuable green corridor so close to our city – major hub for recreation. Once lost it can never be replaced Most cities are trying to create these green corridors into their cities to encourage bird life back into the city centre. | Maitai Valley Development The planned Maitai Valley housing development must not go ahead. The Maitai Vally is ”the jewel in the crown” of Nelson City and a treasured recreational area for many generations of Nelsonians. The creation of a suburb in this beautiful location would compromise the swimming holes, picnic areas and parks which are enjoyed by so many. A new suburb would, inevitably, spill over into the start of the Maitai Valley and some of these much-enjoyed and free recreational activities would be compromised, if not destroyed. We must protect this wonderful valley from destruction, as once it is gone it is too late to recover it. Other tracts of land can be used for new affordable housing builds. We have the example of the very built-up Brook Valley and this area has lost much of its charm with so much in-fill housing. We know the Maitai River is prone to flooding, especially in this area, as evidenced by the 2021 floods, when locals became trapped in the Maitai Valley. The Maitai Valley region is very cold in winter and, as such, is not suited to a suburban housing development. Please leave this sacred area alone and don’t spoil it forever. | I do not support any Council expenditure towards the 'Mahitahi Bayview' subdivision. The developers are expecting to make millions of dollars from the subdivision and they should be paying every last cent for its development, not ratepayers. My prediction is that the subdivision will be a financial and environmental disaster. Much of the land is on a floodplain. The run-off and waste generated will be very difficult to manage and inevitably there will be pollution and degradation of the Maitai River. The subdivision was approved by Commissioners who essentially ignored what occurred during the August 2022 weather event that turned the lower Maitai Valley into a lake. Every week there are warnings from the insurance industry that we should not be building on floodplains or on slip prone areas. So why would the Council be even considering supporting the subdivision with almost $24 million of ratepayer contributed funds? The long term plan (page 43) states that the funding will occur between 2024 and 2032 and will be used to progress trunk services and upgrades to transport connections. It states that a good part of this will be recovered from the developers through development contributions for their share of infrastructure required for growth. This is an amazingly naïve assessment – there is a significant chance that, because of cost blowouts, Council will be called upon to bail-out the developers or forced to compromise on environmental standards because the developers say they are too costly to implement. This leads to another prediction: little if anything of Council’s $24 million contribution, if that occurs, will ever be recovered from the developers. The Nelson City Council should distance itself from the subdivision as much as it can. If it wants to protect itself from future exposure it should ensure, at every level where consents are sought, that the very highest compliance standards are imposed. Otherwise the subdivision will become a financial burden for the Council which, in the future, will find itself regularly having to deal with problems as they arise. These problems are likely to include flood clean-ups, pollution clean-ups, and demands for buy-out of damaged properties. Unhappy house owners facing enormous bills will undoubtedly try to sue the Council on the basis that its approval of the development or specific building approvals should never have been given. This could well occur after the developers have moved onto the next subdivision and banked their profit. They will certainly not have any interest in helping the Council out. | This submission is in support of all current and proposed funding for utilities and transport connections from the Maitahi Bayview subdivision Growth Projects to enable growth of the Nelson region in accordance with the FDS. There is currently allocated funding and it is our understanding the infrastructure this funding will enable, will provide capacity to support these FDS identified growth areas, provide added infrastructure resilience and enable Maitahi & Bayview projects. A 2019 Property Economics report for the combined Maitahi Bayview growth area estimated ongoing economic activity injection into the Nelson Regional economy at $17.56 million for retail and $6.90 million for commercial annually. The report also identified the following potential and economic benefits: Housing choices, Housing Price, Infrastructure efficiency, Spending retention, Support for the Nelson City Centre, Support to economic activity. This is significant given Maitahi and Bayview proximity (less than 3km) and positioning (North East) relative to Nelson City Centre and with respect to recent media citing a recently published ASB Regional Economic Scoreboard for 2023, showing Nelson at the bottom of 16 regions. | Mahitahi Bayview Infrastructure: I oppose the proposed $23.8m for infrastructure to facilitate the Mahitahi Bayview development. The Council's own Future Development Strategy (FDS) states it will "prioritise growth in the existing urban areas, and support the uptake of intensification opportunities to promote consolidated urban form and support a reduction in greenhouse gas emissions." Council's Plan Change 29 clearly is trying to give effect to this through infill and intensification. The developers have taken a punt on leapfrogging the growth priorities in the previous FDS and the current one, and are in fact undermining the Council's stated objectives, for their commercial gain. I see no reason that the Council and ratepayers should go as banker to provide out-of-phase infrastructure to this private development when it is diverting badly needed funds from other areas of need in the city, and in particular when it undermines Council's own intensification objectives. It is important that Council's infrastructure, regulatory and strategic plans all work together, and that Council remains stanch on them. If someone has a bright idea to rezone and development land on the fringes of the city, where future development is not programmed by Council to occur and be serviced for 10 or 20 years, then the developer should just wait their turn in the queue. Every time the Council says "fine, we'll just re-jig our strategies to suit you - and we'll go banker for it" it undermines everyone else's confidence in the Council's strategies plans, and it sends the signal to other developers that the Council and the strategy is a soft touch. | 1002.7 |

The impact on roading and the environment in general will be huge and I am dismayed that most Councillors do not seem to take this into consideration. They want housing at any cost. This subdivision will commit council to heavy long term expenditure in areas like upgrading the water treatment plant and cause further suffering to lower income earners through inevitable rate rises. According to RMA experts the proposed subdivision will increase the flood risk to properties downstream of it and expose Council to compensation claims. Current research shows it is extremely risky to build upon a flood plain as is proposed in the Kaka and that large greenfields developments are not financially sustainable. To push ratepayers into water restrictions earlier each year with the 900 new homes water consumption. Nelson has so many new developments, Marsden Valley, Atawhai etc, in-fill housing, apartment blocks, Kainga Ora etc. Why not look after the rate payers you have with the money they have paid, instead of developers and prospective ratepayers. Nelson City falls short in so many ways and will only worsen with the go ahead of this development. The Plan Change on the Maitai Valley side in Kaka Valley was hugely unpopular with Nelson residents as illustrated by the vast majority of submitters in the Commissioners Hearing and the FDS 2022 opposing urbanization in this part of the Maitai. This sentiment was also supported by the 13000 strong petition to the Council opposing PPC28. NCC should act with more regard for public sentiment and definitely should not help fund such an irresponsible and unpopular project. Council funded infrastructure projects in the Maitai Valley in conjunction with the proposed Kaka Valley urbanization will adversely impact the environment and the highly valued tranquil rural nature of the Maitai Valley, both at the construction phase as well as permanently in future. It would also facilitate further undesirable future urbanization of the Maitai Valley, such as on Orchard Flats. Many of these negative impacts will be impossible to mitigate. These include the enormous increase in traffic as well as noise, air and water pollution and an unacceptable increased flood risk for Nelson residents currently residing flood prone areas downstream. The infrastructure funding will contribute to unacceptable disruption to both the Maitai Valley road and utility of the nearby recreation reserves, including the popular swimming holes. Grey water infrastructure beneath or alongside these recreation reserves risk negatively impacting the environment, as much of this would be in the flood zone. For this reason I am also particularly opposed to locating any sewage storage tanks and pumping facilities on the Maitai floodplain. These would carry the additional risks of breaches during floods as well as the risk of foul odors in the reserves during maintenance or malfunctions. In a declared climate emergency it is also unacceptable for NCC to support Greenfield development that is not contiguous with existing suburbs, such as in Kaka Valley, particularly because of the environmental cost of the required infrastructure. The rural nature of this part of the Maitai Valley should be upheld and I oppose Council support of it's urbanization, including the proposed $24 million dollar infrastructure funding. If it goes ahead, it will destroy the peaceful ambience of the Maitai Valley, it wil increase flood risks down stream due to run off from hard surfaces of 900 houses and roading and part of the planned housing are to be built on a flood plain, it will increase traffic by 7000 car movements per day day, making the presently quiet streets uncomforatbly busy and noisy, there will be massive earthworks with risks of sedimentation going into the Maitai River and the Nelson Harbour. For Council, there will be future expenditure, as always is the case with infra structure maintenance. This will again be a burden on rate payers. With the increased flood risk, Council will again be exposed to claims. Kaka Valley would be a great assett for Nelson if turned into a nature reserve, and the extended Maitai Valley could become a great attraction for tourists and locals alike. I object to my rates being used to line the pockets of the developers or for NCC to take on more risk seeing this area is a very sensitive and high risk environment - flood plain and steep slopes. Who carries the can after the developers have walked away? It's not just the Maitai River affected it is the Haven, Waimea Estuary and Tasman Bay. I would rather this money be put towards more inner city apartments/intensification. The infrastructure and transport connections are already in place - my understanding is it's cheaper to intensify then to put in new, green field infrastructure and roads (they're already there). And the lovely Maitai River and Valley (a Nelson's toanga) can continue to provide a haven for recreational users, so close to the city centre and the above inner city apartment dwellers. The attached photo is of the Kaka Valley floor during the weather event of August 2022 - note a new slip in the background. This weather event was the cause of so many other slips in various parts of Nelson some resulting in NCC buy outs, some not settled yet. | While the ongoing development of recreation trails in the Maitai Valley is supported, their construction and maintenance need to be mitigated by further revegetation in the new areas for trail development noted in the Plan. The Council needs to acknowledge the intrinsic value of our indigenous flora and fauna; not simply how it can be ‘used’ by the human population. We support Council, in conjunction with iwi, exploring the option of the Maitai River as having legal personhood; similar to the Whanganui River. Further residential development in the Maitai River catchment needs to be abandoned to protect and restore biodiversity, and to help reduce the impacts of flooding and erosion downstream. Given the very high likelihood of further major flood events in the Nelson catchment, proactively reducing flood and erosion risk through permanent indigenous plantings needs to be a priority | 1474.30 |
| Mahitahi / Bayview – shamefully buried on page 42 alongside issues such as kitchen waste and play spaces. I strongly disagree with the allocation of any council funding to this subdivision in the plan. There is no detail on why the amount of almost $24M is allocated, whether the NCC investment is capped at this level, and the document speaks vaguely of recovery from developers, without any clarity on how and to what extent this would be achieved. This issue is pressing in urgency and much more transparency is highly desirable. Regardless of the current environment court proceedings, my view is that the future of the valleys in question should be reconsidered. Other countries designate beauty spots as “areas of outstanding natural beauty” and protect them from unfettered development. The Maitai and Kaka Valleys could be preserved as a precious long term natural asset for the city as it grows, enhancing its livability with positive economic impact. Other cities achieve this through green belts and large parks for example. Maybe the land could be acquired for the community to be set aside as a regional park. At least a moratorium could be placed on development subject to renewed consultation. The Maitai is a rare and historic example of a beautiful river valley, so close to our town centre and has been a crucial part of our flood protection throughout the period of Nelson’s settlement. From all feedback this is not a popular development locally and there must be more innovative options for housing that don’t involve selling the soul of the city in this way for old fashioned urban sprawl on unstable hillsides. This issue is at least as important to local people as surf club, artificial turf and arts hub and should be part of the consultation. The desire of many long-term Nelson residents to continue to enjoy their much-loved neighbourhood recreational areas that they have always known are being repeatedly overlooked in council publications. There is considerable dismay, indeed horror for long term residents and property owners at the way things have been evolving with a series of uncomfortable surprise announcements and news snippets. My written comments on this to mayor and councillors have met with one (supporting) response only. Otherwise ignored. Much more transparency is highly desirable at this point and a proper long term cost benefit analysis, allowing all relevant factors to be aired. This quiet and beautiful area of the world could be planned as a long term livability asset and a dark sky area for the wider city, but this development plan renders it as a major long term water infrastructure and transportation liability. Fundamentally, at a personal level, my property in the area was affected in the 1970 Maitai flood event. Fortunately, as a result of flood protection changes at the Branford Park area at the time, in 2022 it escaped impact. However, intensified rapid runoff from the impermeable surfaces associated with 900 new properties up the Kaka Valley and on the Maitai floodplain by common sense seems to heighten the risks of sudden flood damage downstream, especially given the increasingly frequent major weather events. | The proposed Maitai subdivision NO ratepayers money to be spent on supporting private enterprises. To destroy recreational areas for sprawling subdivisions is wrong. The NCC has protected this particular area for recreation for over 100 years. - The whole entrance into the Maitai Valley will become like any other urban area, hence no longer a recreational area. - The entrance to the Matai Valley is on a natural floodplain. What will the future consequences be for those residents? And all the costs, initial and ongoing, to the ratepayers, for earthworks to ameliorate hazards to support this private enterprise? - Pollution downstream. Killing the swimming holes. Another recreational pastime killed. - As a Brook resident the thought of traffic congestion, with another 6-7000 cars, getting out of the Brook or into the Maitai is unreasonable. | 1481.2 |
| I do not support any Council expenditure towards the 'Mahitahi Bayview' subdivision, for the following reasons: The subdivision is inappropriate for the locality as has been argued for many years. RMA approval of the subdivision cannot and has not taken into account the grossly detrimental effect urbanization of the Maitai will have on valley and downstream amenity values. Nelson’s last undeveloped valley. There are many engineering challenges involved in the development earthworks, none of the solutions are a sure bet, with the Maitai River /Haven/Tasman Bay being the ultimate loser. Climate change related risk of rain events exceeding the planning flood parameters. Insurance companies are emphasizing the risks of building in risk prone areas. There has been to date no overall detailed subdivision plan, the current structure plan is nothing more than the developer’s wish list…the proposal as put forward may not be physically possible. Shape Nelson is all about our “smart little city”. There’s nothing smart about supporting this expensive and unnecessary Greenfield development. Who is going to live in these valley houses ? The developers have said there will be no affordable homes built without external funding. So far to my knowledge there has been a Govt. shovel ready funding application turned down along with two special iwi housing fund applications. What does this indicate about the scheme? If housing is to be built in Kaka Valley then the existing approvals for a 40 lot lifestyle subdivision should proceed. These could all be self sufficient with water and sewerage ,thus negating the need for $24 million LTP funding. And somewhere in NCC policy is stated that people should be provided with a choice of type of property. | 1500.2 |
| I would like to express my concern over the Long Term Submission regarding the proposed Maitai Sub division. Permitting housing on a flood zone & exposing nearby households to increased flood risk may make Council liable to a multi million dollar compensation to affected households, should these extra flood risks be realised. As a household that was affected by the August 2022 flooding, with severe damage to our property resulting in over $100,000.00 worth of damage, I am extremely concerned on what the future would hold for us should this sub division go ahead. The Maitai river is unable to cope as it is with extreme rainfall and building on the Maitai flood plain will only make this worse for properties further down - including us. The other problem will be traffic congestion. The give way at the Maitai Valley road/Nile St is already problematic and another 6/7000 estimated vehicles is going to make this a nightmare. | 1501.2 |
| Attached is a copy of a letter that I wrote to Council regarding the state of the Nile St sewer and my concerns on the effect of the Kaka subdivision. I have lived in Nile St for 72 years. During this time I have witnessed several floods. Over the last 20 years when we have had a large flood the Nile St sewer blocks and overflows into my driveway outside my front door through the manhole at the head of the drain. During the August flood this of course happened I emailed the council and let them know what was going and never received a follow up reply. (See pictures in attachment). The sewer from above the Normanby bridge is pumped under pressure into the Nile St sewer below the bridge. When the Nile st sewer blocks I get the lot pumped from above the bridge into my drive right outside the front door. What will happen when we have 750 houses from the proposed subdivision sewer also pumping into the overworked Nile St sewer? The $600,000 of the ratepayers money promised by the council would not go anywhere near correcting this problem. Of course the sewer from the subdivision will have to be laid and pumped around Dennes Hole and down through through Branfield Park to connect the Nile St sewer. When the river floods like it did last August the stormwater will gather on the lower houses and enter through the gully traps into the sewer and this also will be pumped into the sewer system and into Nile St. Stormwater retention ponds will be as small as possible because they will be taking up space that could be sold for housing so don't count on them to stop any flooding. You will not be aware that the water in the flood in 1953 came from a large weather bomb in the Sharlands Creek catchment. The river where the dam is never flooded. A weather bomb in the Kaka Valley of the same size would be an absolute disaster. The only saving grace for the August flood was that it started in the daylight. You could only imagine what would happen if we had a flood of the same proportions during the night. Esk valley all over again and this time Nelson may not be so lucky fatalities could occur. Since I have written this letter I see that the council is planning to give 28 million dollars of ratepayers money to the developers. I find this abhorrent that the developers should be given this sum to aid them in what is a commercial project. No consideration has been given to; Flooding Having seen 74 years of flooding in the Maitai first hand I believe that properties downstream are in severe danger Traffic One can only imagine the congestion that this subdivision will cause. The existing roading will never support the volume of traffic that it will produce. Effect on the Maitai River. I watch the health of the river daily and have seen it decline since the dam went in and it is not getting any better. Having spent my childhood swimming and fishing in the river I can see the way that the fishlife has declined. Construction of the subdivision will have an adverse effect on the river, followed by the runoff from vehicles being washed in. | 1504.2 |
